Every waveform in the product is synthetic. It is generated by software from published grading definitions and does not come from, analyze or interpret any real patient or ultrasound machine.
Do not use this product to make decisions about the care of any patient. Always rely on your own training, direct examination of the patient, your institution's protocols and consultation with qualified colleagues.
Venous Congestion Trainer ("the product") is created and sold by James Napolitano ("we", "us"). By buying, unlocking or using the product, you agree to these terms. If you do not agree, do not use the product.
The product is intended for healthcare professionals, students and trainees who are at least 18 years old. You are responsible for making sure your use complies with the rules of your employer, school or training program.
When you buy the product, we grant you a personal, non-exclusive, non-transferable, revocable license to use it for your own education. A standard license may be activated on up to three browsers or devices that you personally use. Group and program licenses are available under a separate written agreement.
We may disable a license key that is shared or misused.
Orders are processed by Lemon Squeezy, which acts as the merchant of record and reseller for the product. Lemon Squeezy handles payment, billing, receipts and sales tax, and its own terms and privacy policy apply to the checkout. Prices are shown at checkout and may change. A price change does not affect a purchase you have already made.
If the product is not useful to you, email [email protected] within 14 days of your purchase and include the email address you used at checkout. We will issue a full refund through Lemon Squeezy. When a refund is issued, the license key is disabled and access ends. Requests after 14 days are handled case by case. This policy does not limit any refund rights you have under the law where you live.
We may update, improve or change the product, including its content, at any time. We aim to keep the product available but do not guarantee uninterrupted access. The product runs in a web browser and requires an internet connection. We may discontinue the product; if we do so within 12 months of your purchase, we will offer a prorated refund on request.
The product, including its software, text, design and waveform models, belongs to us and is protected by copyright and other laws. "VExUS" refers to a published clinical grading system and is used here only to describe the content. The product is not affiliated with, sponsored by or endorsed by the authors of VExUS or any company that uses that name. Cited articles belong to their respective publishers and authors.
The product is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the content is free of errors or that the product will meet your needs.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from clinical decisions, patient outcomes, lost data or lost profits, arising out of or related to the product, even if we were told such damages were possible. Our total liability for any claim related to the product is limited to the amount you paid for it in the 12 months before the claim. Some jurisdictions do not allow some of these limits, so they may not all apply to you.
You agree to indemnify and hold us harmless from claims, losses and expenses, including reasonable legal fees, that arise from your misuse of the product, your violation of these terms, or any clinical decision you make.
These terms apply while you use the product. We may suspend or end your access if you break these terms. Sections 2, 5 and 9 through 14 continue to apply after your access ends.
These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in New York, and you consent to their jurisdiction. If any part of these terms is found unenforceable, the rest remains in effect.
We may update these terms. The effective date at the top of this page shows when they last changed. Continuing to use the product after a change means you accept the updated terms.
